Official Terms and Conditions for SMS Opt-In Giveaway

1. Eligibility:

   • This giveaway is open to legal residents of the United States who are at least 18 years old at the time of entry.
   • Employees, affiliates, subsidiaries, advertising and promotion agencies, and immediate family members of dadada Baby are not eligible to participate.

2. Sponsor:

   • This giveaway is sponsored by dadada Baby, located at 24 W. Railroad Ave. Suite 110, Tenafly, NJ 07670.

3. Entry Period:

   • The giveaway begins on November 11, 2024, at 12:00 AM EST and ends on December 8, 2024, at 11:59 PM EST.

4. How to Enter:

   • To enter, participants must opt-in to the Dadada Baby SMS list on the dadadababy.com website
   • Standard messaging and data rates may apply.

5. Prize:

   • One (1) winner will receive a $500 gift certificate redeemable at dadadababy.com only.
   • The gift certificate is non-transferable, cannot be exchanged for cash, and expires one (1) year from the date of issuance.

6. Winner Selection and Notification:

   • The winner will be selected at random from all eligible entries received during the entry period.
   • The winner will be notified via SMS at the phone number provided during entry within 30 days of the giveaway’s end date.
   • If the winner does not respond within seven (7) days of notification, an alternate winner may be selected.

7. Conditions of Participation:

   • By entering, participants agree to comply with these terms and all decisions of the sponsor, which are final and binding.
   • By providing their phone number, participants consent to receive promotional SMS messages from Dadada Baby. Participants can opt-out at any time by texting “STOP.”
   • The winner may be required to complete an affidavit of eligibility and liability/publicity release before receiving the prize.

8. Publicity Release:

   • By accepting the prize, the winner agrees to allow Dadada Baby to use their name, likeness, and entry for promotional purposes without additional compensation or approval, except where prohibited by law.

9. Limitation of Liability:

   • Dadada Baby is not responsible for lost, late, misdirected, incomplete, or undeliverable entries, or technical failures that may affect participation in the giveaway.
   • Dadada Baby is not responsible for any injuries, losses, or damages of any kind arising from participation or use of the prize.

10. Privacy Policy:

    • Personal information collected for this giveaway is subject to Dadada Baby’s Privacy Policy, available at https://dadadababy.com/pages/privacy-policy.

11. Void Where Prohibited:

    • This giveaway is void where prohibited by law.

12. Dispute Resolution:

    • All disputes arising out of or connected with this giveaway will be resolved individually, without resort to class action, and exclusively in the appropriate courts located in New Jersey.

13. Modification and Termination:

    • Dadada Baby reserves the right to modify, suspend, or terminate the giveaway at any time, for any reason, without prior notice.
